Dryllerakis Law Firm is pleased to announce that our Partner, Claire Sergaki, participated as a speaker in the 8th International Arbitration Conference organized by Nomiki Vivliothiki and EODID. This year’s conference was dedicated to guerilla tactics in international arbitration and the question of whether arbitration can remain both flexible and legitimate.
Claire spoke on the panel titled “Can Arbitration Defend Itself? Tribunal Powers, Institutional Responses and Procedural Integrity,” which examined the tools available to tribunals, national Courts, and arbitral institutions to counter bad-faith procedural conduct and preserve the integrity of arbitral proceedings and the enforceability of awards.
Claire contributed to a lively discussion covering a range of topics. She shared examples from her practice of late submissions and the introduction of evidence at the hearing as forms of guerilla tactics and examined the tools available to tribunals to address such conduct, including the cost allocation powers and compensation mechanisms available under Greek arbitration Law. She also presented an overview of Greek case law on the response of national courts to dilatory tactics, drawing on judgments of the Civil Supreme Court.
