21st Athens Tax Forum: Dimitris Karavas on the contribution of the European Court of Human Rights to judicial protection

03/11/2025

On November 3rd, our Partner Dimitris Karavas participated as a speaker at the 21st Athens Tax Forum of the American-Hellenic Chamber of Commerce, delivering a presentation entitled “The contribution of the European Court of Human Rights to judicial protection: Comment on Georgiou v. Greece.”

During his intervention, he highlighted the close connection between the preliminary reference mechanism under Article 267 TFEU and the right to effective judicial protection, as enshrined in the European Convention on Human Rights. He stressed that the limited recourse of Greek Courts to preliminary references, particularly in the fields of Tax and Customs Law, not only reflects a deficit in EU Law compliance but may also constitute a breach of the ECHR guarantees on fair trial and judicial protection.
